⚠ BETA NOTICE — CreekBite is currently in beta testing. Features, route data, float time estimates, waterway information, access point data, and conditions scores may be incomplete, inaccurate, or unavailable. Use this application accordingly.

Welcome to CreekBite ("CreekBite," "we," "our," or "us"). By accessing or using the CreekBite application at creekbite.com or creekbite.app, you agree to be bound by these Terms of Service. If you do not agree, do not use the app.


01 Description of Service

CreekBite is a fishing conditions and waterway navigation application that provides creek conditions data, bite score predictions, float planning tools, GPS trip tracking, waterway access information, and related features for wade and kayak anglers. CreekBite is an informational tool only and is not a safety or emergency navigation system.

02 Outdoor Activity & Safety Disclaimer

IMPORTANT — READ CAREFULLY. Outdoor recreation, including wading, kayaking, and creek navigation, involves inherent and serious risks including but not limited to: drowning, injury from swift current, submerged hazards, deadfalls, flash flooding, remote location emergencies, and exposure to extreme weather. These risks exist regardless of skill level or experience.

CreekBite provides informational data only. All decisions regarding whether to enter, wade, float, or navigate any waterway are solely your responsibility. By using CreekBite you acknowledge and accept full responsibility for your personal safety and the safety of any persons in your party.

You agree that CreekBite:

Waterway conditions change rapidly and without warning. CFS readings, water levels, access conditions, hazard locations, and float estimates provided by CreekBite may be delayed, inaccurate, or incomplete. Always verify conditions independently before entering any waterway.

03 Water Conditions Disclaimer

Conditions data are estimates only. Float times, difficulty ratings, CFS readings, water temperature, bite scores, and other conditions data provided by CreekBite are estimates based on third-party data sources and automated calculations. They are not guarantees of actual conditions.

You must independently assess and verify conditions before any trip. Do not rely solely on CreekBite data when determining whether conditions are safe.

04 Access Point & Waterway Data Disclaimer

Access point information provided by CreekBite, including bridge access points, boat ramps, fords, and community-submitted access data, may be outdated, inaccurate, or incomplete. Public and private access status can change at any time.

05 GPS & Location Services

CreekBite uses your device's GPS and location services for features including nearby gauge detection, trip tracking, float progress, and waterway navigation. Location access is optional but required for certain features.

06 Offline Float Maps & Downloaded Data

CreekBite allows users to download float packages for offline use, including map tiles, route data, and waterway information. You acknowledge that:

Offline Float Mode must be downloaded before losing service. Always download your float package at home or with a reliable connection before heading to the water. Do not rely on offline float data as your only navigation resource in remote or emergency situations.

07 User Accounts

You must create a free account to use certain features. You must be at least 13 years of age to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use at creekbite@gmail.com.

08 Acceptable Use

You agree not to use CreekBite to: (a) violate any applicable law or regulation; (b) trespass on private property; (c) post false, misleading, or harmful content including inaccurate access point data; (d) attempt to reverse-engineer, scrape, or copy the application; (e) interfere with the proper operation of the service; (f) submit access confirmations or trip data for locations you have not personally visited.

09 Field Tester Program

Users selected for the CreekBite Field Tester program agree to provide honest, accurate feedback and data submissions. Field testers acknowledge they are using pre-release beta software that may contain bugs, inaccurate data, or incomplete features. CreekBite reserves the right to modify or discontinue the field tester program at any time.

10 User Content

By submitting content (access confirmations, wading ratings, trip data, photos) to CreekBite, you grant us a non-exclusive, royalty-free license to use that content to operate and improve the service. You retain ownership of your content. You represent that your submissions are accurate to the best of your knowledge.

11 Intellectual Property

CreekBite™ and the CreekBite logo are trademarks of CreekBite. The application design, bite scoring algorithms, float planning system, and interface are original works protected by copyright. Unauthorized reproduction, copying, or redistribution is prohibited.

12 Disclaimers

CreekBite is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, uninterrupted, or that any data will be accurate or complete. We expressly disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13 Limitation of Liability

To the fullest extent permitted by applicable law, CreekBite and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, property damage, loss of data, or any harm arising from your use of or reliance on this application, its data, or its recommendations. Your sole remedy for dissatisfaction with the service is to discontinue use.

14 Indemnification

You agree to indemnify and hold harmless CreekBite and its owner from any claims, damages, losses, or expenses (including legal fees) arising from your use of the application, your violation of these Terms, or your outdoor activities in connection with use of CreekBite.

15 Changes to Terms

We may update these Terms at any time. When material changes are made, we will prompt you to review and re-accept the updated Terms on your next login. Continued use after acceptance of updated Terms constitutes your agreement to the new Terms.

16 Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.
